Terms of Service

1. Acceptance of Terms

By creating an account or using Watchling ("the Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, you may not use the Service. These Terms constitute a legally binding agreement between you and Watchling.

2. Eligibility

You must be at least 16 years of age to use Watchling. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

3. Account Registration & One Account Per Person

You must register for an account to use Watchling. You agree to provide accurate, current, and complete information during registration and to keep it up to date.

One account per person/entity. Each individual or organisation is permitted one free-tier account. Creating multiple free accounts to circumvent plan limitations — including but not limited to monitor limits or check interval restrictions — is strictly prohibited and constitutes a material breach of these Terms. Accounts found to be in violation will be suspended or permanently terminated without notice. If you require additional capacity, please upgrade to a paid plan.

You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately at [email protected] if you suspect unauthorised access to your account.

4. Acceptable Use Policy

You agree to use Watchling only for lawful purposes and in accordance with these Terms. You agree NOT to:

Monitor systems you do not own or lack explicit authorisation to monitor. Using Watchling to probe or monitor third-party infrastructure without the owner's permission may constitute unauthorised computer access under applicable law.
• Use the Service to conduct or facilitate any form of denial-of-service (DoS) or distributed denial-of-service (DDoS) attack.
• Use the Service to scan for vulnerabilities in systems you do not own.
• Use the Service in connection with any illegal activity, including but not limited to hacking, phishing, fraud, or the distribution of malware.
• Use the Service to monitor or collect data on individuals without their knowledge or consent in violation of applicable privacy laws.
• Abuse, harass, threaten, or harm Watchling staff, other users, or third parties.
• Attempt to circumvent rate limits, access controls, or technical restrictions of the Service.
• Use automated scripts or bots to create accounts, bypass plan limits, or interact with the Service in a manner not intended by its design.
• Resell, sublicense, or otherwise commercialise access to the Service without our written consent.

5. API Monitoring — Response Size Limits

Maximum response size: 100 KB per check. To protect the stability and performance of the platform for all users, Watchling enforces a maximum API response body size of 100 KB (102,400 bytes) per monitoring check.

If a monitored API endpoint returns a response body exceeding 100 KB on a check, the Service will begin tracking the date the oversized response was first observed. If the response continues to exceed 100 KB for more than 3 consecutive days, the affected API monitor will be automatically disabled and you will receive an in-app notification explaining the reason.

You may re-enable the monitor from your dashboard once you have reviewed the endpoint and confirmed that future responses will remain within the 100 KB limit. Watchling accepts no liability for missed alerts or monitoring gaps that arise as a result of a monitor being automatically disabled under this policy.

6. Fair Use & Abuse Prevention

We operate on a fair-use basis. Watchling reserves the right to throttle, suspend, or terminate accounts that consume a disproportionate share of system resources, generate abusive traffic, or otherwise degrade the service for other users. We will attempt to contact you before taking action, except where immediate action is necessary to protect the integrity of the Service or other users.

7. Free Plan Limitations

The free plan is provided as a genuine, permanent free tier with defined limits (5 website monitors, 2 server monitors, 2 API monitors, 5-minute check intervals). These limits are per account and per legal entity. Any attempt to artificially inflate free-tier capacity — including by registering multiple accounts under different email addresses for the same person or organisation — will result in account termination. If your needs exceed the free tier, please upgrade to a paid plan.

8. Paid Plans & Billing

Paid plans are billed on a monthly or annual basis. By subscribing, you authorise us to charge your chosen payment method on a recurring basis. You may cancel your subscription at any time from your account settings; cancellation takes effect at the end of the current billing period. Refunds are provided at our discretion within 30 days of initial purchase.

9. Service Availability

We aim to provide a reliable service but do not guarantee 100% uptime. The Service is provided "as is" and "as available". We reserve the right to perform maintenance, upgrades, or changes that may result in temporary interruptions. We will endeavour to provide advance notice of planned maintenance where possible.

10. Data & Monitoring Targets

You retain ownership of all monitoring targets and configuration data you add to Watchling. By using the Service, you grant us a limited licence to perform monitoring checks on the targets you specify on your behalf. You are solely responsible for ensuring you have the right to monitor any system or URL you add to the Service.

11. Intellectual Property

All content, software, and branding associated with Watchling (excluding your data) is owned by or licensed to us. You may not copy, modify, distribute, or create derivative works from any part of the Service without our express written permission.

12. Termination

We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms. You may delete your account at any time from your account settings. Upon termination, your access to the Service will cease immediately, and your data will be deleted in accordance with our Privacy Policy.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Watchling shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total liability to you shall not exceed the amount you paid to us in the 12 months preceding the claim.

14. Disclaimer of Warranties

The Service is provided without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. Watchling does not warrant that the Service will be uninterrupted, error-free, or that monitoring results will be 100% accurate.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation, and if necessary, binding arbitration or the courts of the jurisdiction in which we operate.

16. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes via email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
